This Terms of Service Agreement explicitly states the terms and conditions governing the use of the services, including technology and content, of HostRegion (HostRegion). By signing up for a HostRegion account, you (The Client) accept these terms and conditions and acknowledge that your use of HostRegion’s services is subject to certain limitations set forth below. If you do not accept this agreement, do not complete the sign-up process.

HostRegion reserves the right to amend or change the Terms of Service Agreement at any time without prior notice, provided that the current Terms of Service Agreement is made available to The Client through HostRegion’s Web site, and that The Client can terminate The Client’s obligations under this agreement by deleting The Client’s account with HostRegion.

This agreement incorporates HostRegion’s Privacy Policy and Billing Policy as part of its terms.

1. Money Back Guarantee. HostRegion offers all Shared and Reseller customers a 14 day money back guarantee. If for some reason you are unsatisfied with the production of HostRegion, we will refund 100% of your money excluding any setup fees. If for some reason you do cancel within this policy, HostRegion will require you to provide justification of your cancellation, as only valid reasons will be granted refunds. Valid reasons include service uptime, support and general performance. 3rd party providers such as our Sub-Resellers or Client Exec cancellation reasons will not be granted, as these features are beyond our control.

THIS POLICY IS TERMINATED IF

a. Canceling account for the sole purpose of obtaining a refund and then registering for a new account
b. Knowingly providing false or misleading information when you register your account
c. Creating multiple accounts, sing the same customer name or different customer names.
d. Account has been found spamming (please see Account Termination for more details)

2. Service Level Agreement . All HostRegion hosted services come with a service level agreement (SLA).

a. Shared Hosting and Reseller Account Service Level Agreement of 99.999%. This SLA is specifically for our Shared Hosting and Reseller Account customers. HostRegion guarantee's that your website will be up for at least 99.999% of the time of a month. As of 6/15/05, If for some reason your website's) are down due to a service failures or server downtime for a full 15 minutes, the customer may request a pro-rate for the amount of downtime. This is completely up to the customer to file for credit, which must be filed within 4 days of the outage. Please send evidence of the outage or service interruption and the credit request to billing@HostRegion.com

b. Dedicated Servers Service Level Agreement of 100%. This SLA is specifically for our dedicated server customers. If for some reason your server is down for a full 15 minutes, the customer may request a pro-rate for the amount of downtime. This is completely up to the customer to file for credit, which must be filed within 4 days of any outage. Please send evidence of outage and request to billing@HostRegion.com.

3. Refunds. All payments to HostRegion Internet are non-refundable no matter of the situation. Unless you are within the 14 day purchase of a shared or reseller plan, refunds will not be granted. Charge backs will also be declined as you The Client has agreed to this policy upon signup.

4. Verification. To protect ourselves, HostRegion initiates a call for each sale that is done through HostRegion. This is used to protect ourselves from fraudulent orders and charge backs, as well to protect our servers. If for some reason you are unable to proceed with our call verification system, you are required to e-mail account management@HostRegion.com with a valid reason. This call is also sent / compatible with every country in the world.

5. Account Activations / Server Setup. For shared and reseller customers, your account will be instantly setup after payment has been received and approved by our billing system, however if for some reason HostRegion suspects a fraudulent transaction, your account may be placed on hold for further investigation.

6. Account Termination / Cancellations. HostRegion does not require you to notify us any time in advance, however we recommend you do contact us in advanced upon your discretion. All account cancellation requests must be sent to cancellations@HostRegion.com. After we have received your request, your account will be terminated and your subscription to HostRegion will be canceled as soon as a HostRegion representative as viewed your e-mail. This process can take up to 72 hours. Furthermore, HostRegion ourselves has the right to terminate your account or temporary suspend your account if you meet one of these requirements:

a. Spam. HostRegion has ZERO-TOLERANCE for Spam! All shared and reseller accounts caught spamming will be terminated, without permission to retrieve a backup of files and/or folders on the account (from backup server). Resellers hosting spammers may or may not receive an e-mail that HostRegion has terminated an account for spamming.

b. No Payment. HostRegion issues an invoice 10 days prior to your actual billing day and sends a reminder 3 days before the billing date. If by this billing date payment is not received, you will be required to pay a late fee of $15. After 15 days, HostRegion has full rights to terminate the account with notice.

c. Child Pornography. Although HostRegion does allow Adult pornography, child pornography is prohibited to be hosted on any of HostRegion's servers. HostRegion must comply with the federal government in effect, if you are caught with child pornography, your account / server will be suspended. Dedicated Server customers will receive a 24 hour disconnect warning to remove the child pornography to avoid suspension.

d. IRC Servers. HostRegion does not allow IRC servers to be hosted on our network. IRC gives us the potential of a DDOS attack, which can cause a major spike in bandwidth. Servers caught hosted IRC will be tooken offline.

7. Services / Reliability - The Client is responsible for regularly monitoring and creating backups of The Client’s own files and agrees to use HostRegion’s resources and infrastructure at The Client’s own risk. Neither HostRegion nor its partners, parent, affiliates or subsidiaries make any warranty with respect to any content, information, services or products provided through or in conjunction with HostRegion’s services. HostRegion is also not liable to The Client or any third party for any damage, direct or incidental, that could occur as The Client uses HostRegion’s services. HostRegion is not responsible for the delivery or quality of any goods or services sold or advertised through HostRegion network of web sites, its affiliates or through The Client sites. HostRegion does not guarantee that its security procedures will prevent the loss of, alteration of, or improper access to The Client’s information. 8. Fees - HostRegion has a general guide of fee's that is generally  used for every hosting company.

a. Late Payment Fee: $15.00 Reactivation for Shared Hosting, Reseller Accounts and Dedicated Server customers is required for service re-activation.

9. Privacy Policy - HostRegion is committed to safeguarding your privacy online.  This statement is therefore set out to outline how we make use of the information you submit to us during registration.  The terms contained on this page may be revised from time to time.  To protect your interests, visit this page periodically to review the current terms of our policy.

Personal information is requested when you register to be a member.  During registration, you are asked to provide your name, email address, birth date, gender, postal or zip code, occupation, industry and personal interests, etc.  The more information you submit and the more accurate it is, the better we are able to tailor our services to your needs. 

HostRegion's purpose in collecting personal information is to identify the member as well as to send recent updates and important announcements via post and/or email.  HostRegion does research on our members' demographics and interests based on the information you submitted to us upon registration.  We do this to better understand and serve all our members.  This data is compiled, analyzed, and used only by HostRegion.  No part of the information you have provided would be sold, disclosed, or made accessible by third-parties or by the public. 

In our role of delivering targeted advertisements (via email newsletters), HostRegion is the middleman.  Advertisers give us an advertisement and tell us the type of audience they want to reach. HostRegion chooses appropriate advertisements to include in the email to be sent to the target audience.  In this process, the advertiser never has access to individual account information or any personal member information. 

10. Liabilities - The Client is solely responsible for the conduct of The Client’s business and all other matters under The Client’s control. IN NO EVENT SHALL HostRegion, ITS PARENT, SUBSIDIARIES, AFFILIATES, CONTRACTORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, REPRESENTATIVES OR LICENSORS, OR ANY OTHER PARTY INVOLVED IN PRODUCING, CREATING OR DELIVERING HostRegion's  SERVICE, TECHNOLOGY OR CONTENT, BE LIABLE TO The Client IN ANY MANNER WHATSOEVER FOR LOSS OF OR INACCURACY OF DATA, GOODS, REVENUES, PROFITS, SERVICES, OR TECHNOLOGY OR FOR ANY DIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SIMILAR DAMAGES, EVEN IF HostRegion HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. The Client HEREBY WAIVES ANY AND ALL CLAIMS AGAINST HostRegion AND ITS PARENT, SUBSIDIARIES, DIVISIONS, AFFILIATES, AGENTS, REPRESENTATIVES AND LICENSORS ARISING OUT OF The Client's USE OF HostRegion SERVICE.

HostRegion and its parent, subsidiaries and affiliates shall not be liable for any damages that result from The Client’s failure to perform The Client’s responsibilities in connection with this Agreement or that result from any cause beyond HostRegion's control.

The aggregate liability of HostRegion and its parent, subsidiaries and affiliates arising from this Agreement for any action or claim is limited to any amounts The Client has paid to HostRegion during the term of this Agreement.

In jurisdictions not allowing the limitation or exclusion of liability for incidental or consequential damages, HostRegion's liability shall be limited to the extent     permitted by law.
